1. PURPOSE

These General Terms and Conditions of Sale are entered into between, on the one hand, Nouvelle Compagnie des Détergents et du Savon de Marseille - Savonnerie Fer à Cheval, hereinafter referred to as "NCDSM" and, on the other hand, persons wishing to purchase products sold online on the www.savon-de-marseille.com website (also accessible via www.savon-de-marseille.net or any other url address redirecting to the original site), hereinafter referred to as "the User".
The purpose of the General Terms and Conditions of Sale is to define the conditions under which "NCDSM" provides "the User" with the product(s) he has ordered on the website www.savon-de-marseille.com or any other url address redirecting to the original site) (hereinafter referred to as "the site") as well as the conditions of use of the site.
" The User" is invited to keep a copy of the General Terms and Conditions of Sale available on the day of his order and/or to print them. (22/06/2022 vrs1.0.0)

2. USER COMMITMENT

The "site" is freely accessible to all Internet users. By making purchases on the "site", the Internet user becomes a "User" and must therefore respect the General Terms and Conditions of Sale as well as all the conditions set out in the accessible legal notices.
The placing of an order on the "site" is governed by the present General Terms and Conditions of Sale and corresponds to a contract concluded between the "User" and "NCDSM". When placing an order, the "User" is invited to read the General Terms and Conditions of Sale. It is the responsibility of the "User" to check the box provided for this purpose in the order process only after having read them and possibly having questioned "NCDSM" in case of difficulties before validating his order. The box concerned is the one corresponding to the following sentence: "I have read the general terms and conditions of sale and I accept them unreservedly".
Acceptance of these General Terms and Conditions of Sale implies that the "User" is of legal age and has the legal capacity to enter into a contract.
The "User" must be the end user of the products purchased. Any order intended for resale may be cancelled by our sales department. Any reseller must contact our sales department.
The provisions of this article are supplemented by the provisions of the Terms of use.

3. PRICE

The prices indicated on the "site" are understood to be in euros, inclusive of all taxes (TTC), and exclusive of delivery charges. These prices may be modified at any time by "NCDSM"; the prices displayed are valid only on the day of the order and have no effect for the future.
Delivery costs are indicated to the "User" before the order is validated. The calculation of delivery charges is described in the article " Delivery or Provision " of these General Terms and Conditions of Sale.
NCDSM's offers are valid as long as they are present on the "site". These offers are updated regularly.

4. ORDER

The "User" selects one or more products and adds them to his basket. He may check the contents of his basket at any time. They can move from one step to the next by clicking on the appropriate button.
In order to comply with the provisions of the French law on confidence in the digital economy of June 21, 2004, the ordering process is described below:

  • Step 1: Viewing the shopping basket and choosing the delivery method:
    When viewing the shopping basket, the "User" is able to check the number and nature of the products in the basket, the unit price and the total price of the order (including the least expensive delivery charges), and to remove or add one or more items to the basket.
    At any time, the "User" may decide to move on to the next step or continue shopping. Once the customer is satisfied with the contents of his/her basket, he/she can validate it by clicking on the button provided.
  • Step 2: My details:
    When validating the shopping basket, the "User" accesses a form in which he/she can either enter his/her login details if he/she already has them, or register on the "site" by completing the form presented to him/her, with his/her personal details. Once they have logged in using their login and password, or once they have fully completed the form, "Users" are invited to check or modify their delivery and billing details.
  • Step 3: Choice of delivery method:
    During this step, the "User" will be able to see the amount and terms of the different delivery options and choose the one that suits him best.
  • Step 4: Payment:
    " The User" is invited to pay by credit card, Paypal, Bancontact, Klarna, bank transfer or cheque. In the event of payment by bank card or Paypal, the "User" is redirected to a secure payment interface.
    In the event of payment by cheque or bank transfer, the "User" must comply with the provisions of article "6. Payment" of the present document.
    The payment methods presented at this stage may vary according to various criteria, such as the amount of the basket or the billing address.
    A confirmation screen closes the order process.
  • Step 5: Acknowledgement of order:
    Once payment has been received by "NCDSM", "NCDSM" will acknowledge receipt of the order electronically using the e-mail address provided by the "User" when placing the order, within a maximum of 24 hours.
    Within the same timeframe and under the same conditions, "NCDSM" will electronically send a summary of the order and confirmation that the order has been processed, including all information relating to the order, the products ordered and the delivery method.
    IMPORTANT: Any order that has been confirmed and paid for and is in the process of being prepared cannot be modified.

NCDSM reserves the right to check or cancel any order it deems improper. For orders over 600 euros including VAT, we recommend that you contact our customer service department before finalizing your order.

5. DELIVERY or DISPOSAL

5.1 Place of delivery

Products are delivered to the delivery address indicated by the "User" when placing his/her order, if we offer delivery in the country concerned. Deliveries are made to Metropolitan France and Monaco, DOM TOM, the European Union and selected international countries.

5.2 Delivery charges

Please refer to the delivery section in the footer of the website.

5.3 Delivery times

The delivery time starts to run as soon as the order has been paid for. It includes the time required to prepare the order, estimated at between four (4) and six (6) working days unless otherwise indicated when the order is placed, as well as the time required for the carrier to deliver the parcel. You can find approximate delivery times provided by the carrier on the delivery page.

6. PAYMENT

The following payment methods are accepted on the "site":

  • Credit card (Carte Bleue, Visa, Mastercard)
  • Bancontact
  • Apple Pay
  • Check

Credit card payments are made using secure transactions provided by our partner Mollie.
To increase the security of your banking information, "NCDSM" does not store it. This is why you will have to communicate them to us with each new order.
" NCDSM" reserves the right to suspend or cancel any order and/or delivery in the event of non-payment by the "user", payment incident and/or fraud in the use of the "site" or the means of payment chosen by the "user".
Within the framework of a payment by bank card, "NCDSM" does not have access to any data relating to the means of payment of the "user". Payment is made directly to the bank.
In the case of payment by cheque, the cheque must be issued by a bank domiciled in metropolitan France or Monaco. In addition, the "User" must send the cheque within seven (7) calendar days of placing the order. The check is cashed upon receipt. Once cashed, the order will be processed.
The products, objects of the order, remain the property of "NCDSM" until full payment of their price.
When "the User" places an order in payment by check his order will be shipped only when the check is received.

7. PRODUCT AVAILABILITY

The availability of products is indicated on the "site", in the description of each article.
The unavailability, even prolonged and without any limitative duration, of one or more products, cannot be constitutive of a prejudice for the "User" and cannot in no way give rise to the granting of damages on behalf of "NCDSM".
However, if a product proves to be unavailable after the order has been placed, the "User" will be informed by e-mail to the address provided in the order form, of the delivery of a partial order or of the cancellation of the order.
In accordance with the provisions of article L.121-20-3 of the French Consumer Code, in the event of unavailability, the "User" will be reimbursed for the price of the unavailable product within thirty days of payment of the sums paid.

8. RIGHT OF WITHDRAWAL - RETURN/EXCHANGE

In accordance with current legislation, consumers have a period of 14 days from the date of receipt of the package to retract and request a refund. A further period of 14 days will follow, during which the "User" must return the order, and the "NCDSM" must proceed with the refund.
In order to exercise this right, the "User" must follow the procedure below in order to return the product(s) still sealed in its original packaging. To do this, "the User" must inform "NCDSM" customer service in writing within 14 days, using the following procedure:

  • Send us the completed form, including the order number: Download the withdrawal form (file in PDF format)
  • via the contact form on the website

"NCDSM" will not accept any returns for which the above procedure has not been followed and respected. The reimbursement of delivery costs will be identical to what the "User" has paid.
In accordance with the provisions of articles L.121-20 et seq. of the French Consumer Code, the right of withdrawal may under no circumstances be exercised for :

  • goods made to the consumer's specifications or clearly personalized or which, due to their nature, cannot be reshipped or are likely to deteriorate or expire rapidly,
  • goods which have been unsealed by the consumer after delivery and which cannot be returned for reasons of hygiene or health protection.

If the "User" wishes an exchange, he/she may specify this in a letter accompanying the return of the parcel, or when calling Customer Service (see "Customer Service" article).
Only Products in their original packaging and in perfect condition for resale will be accepted for return or exchange.
The cost of returning the Product remains at the Customer's expense, except in the event of a lack of conformity or proven hidden defects in the Product.

10. WARRANTY FOR PRODUCTS PURCHASED ON THE SITE

10.1 Legal warranty - warranty against hidden defects

In the event of defect of a product purchased on the "site" or of non-conformity of the delivered product, the "User" is invited to contact Customer Service.
" NCDSM " undertakes to refund or exchange, subject to available stocks, a product revealing a hidden defect under the conditions set out in the articles of the French Consumer Code and Civil Code listed below. In the event of a refund request, "the User" will be refunded by bank transfer or credited back to his Paypal account, within a maximum period of thirty (30) days.

10.2 Applicable texts

Article L211-4 of the French Consumer Code: "The seller is obliged to deliver goods that conform to the contract and is liable for any lack of conformity existing at the time of delivery.
The seller is also liable for any lack of conformity resulting from the packaging, assembly instructions or installation when the latter was made his responsibility by the contract or was carried out under his responsibility."

Article L211-5 of the French Consumer Code: "To conform to the contract, the goods must:
1° Be fit for the use usually expected of similar goods and, where applicable:
- correspond to the description given by the seller and possess the qualities that the seller has presented to the buyer in the form of a sample or model;
- present the qualities that a buyer may legitimately expect having regard to public statements made by the seller, by the producer or by his representative, particularly in advertising or labelling;
2° Or present the characteristics defined by mutual agreement between the parties or be fit for any special purpose sought by the buyer, brought to the seller's attention and accepted by the latter. "

Article L211-12 of the French Consumer Code: "Action resulting from a lack of conformity is barred after two years from delivery of the goods.

Article 1641 of the French Civil Code: "The seller is liable for any hidden defects in the item sold which render it unfit for its intended use, or which impair that use to such an extent that the buyer would not have purchased it, or would only have paid a lower price for it, had he been aware of them".

Article 1648 paragraph 1 of the French Civil Code: "The action resulting from redhibitory defects must be brought by the purchaser within two years of the discovery of the defect.

11. PERSONAL DATA

11.1 My account

The creation of a personal space is an essential prerequisite to any order on the "site". To this end, the "User" will be asked to provide certain personal information. The "User" undertakes to provide accurate information, failing which the contract will be terminated at the initiative of the "site" publisher, and his customer account will be deleted. Certain information will be deemed essential to the conclusion of the sale and its collection will be indispensable for the creation of the personal space and the validation of the order. Mandatory information is indicated as such. Refusal by a "User" to provide said information will have the effect of preventing the creation of the personal space as well as, incidentally, the validation of the order.
This space enables the "User" to consult all his orders made on the site, and also enables, where applicable, the tracking of the delivery of products purchased.
" NCDSM" undertakes to keep securely all contractual elements whose retention is required by the law or regulations in force.
The pages relating to personal areas are freely printable by the holder of the account in question, but in no way constitute proof; they are for information purposes only, intended to ensure efficient management of orders by "the User".
When creating a personal area, "the User" is invited to choose a password. This password guarantees the confidentiality of the information contained in the "my account" and "information" sections. The "User" is therefore prohibited from transmitting or communicating it to a third party. Failing this, "NCDSM" cannot be held responsible for unauthorized access to a "User's" account.
" NCDSM" reserves the exclusive right to delete the account of any "User" who has violated these Terms and Conditions (including, but not limited to, when the "User" has knowingly provided false information when registering and setting up his personal space) or any account inactive for at least one year. The said deletion shall not be liable to constitute damage for the excluded "User", who shall not be entitled to claim any compensation as a result.
This exclusion is not exclusive of the possibility, for "NCDSM", of taking legal action against the "User", when the facts so justify.

11.3 "NCDSM" newsletter

By ticking the appropriate box or by expressly agreeing to this, the "User" accepts that "NCDSM" may send him/her, at a frequency and in a form to be determined by "NCDSM", a newsletter which may include information relating to its activity.
When the "User" ticks the appropriate box, he/she accepts to receive commercial offers from "NCDSM" on this "site" for products and services similar to those ordered.
" The "User" may unsubscribe from the newsletter by clicking on the link provided for this purpose in each newsletter.

12. EXEMPTION FROM LIABILITY

In the event of inability to access the "site", due to technical problems or any other reason, the "User" will not be entitled to claim any damages whatsoever and will not be entitled to claim any compensation.
The hypertext links present on the "site" may lead to other Internet sites, and "NCDSM" cannot be held liable if the content of these sites contravenes current legislation. Likewise, NCDSM shall not be held liable in the event that the user's visit to one of these sites causes prejudice.

13. COOKIES

When you visit the "NCDSM" "site", certain information relating to the browsing of your terminal (computer, smartphone, tablet, etc.) may be recorded in files called "Cookies" installed on your terminal.

14. MISCELLANEOUS

The present General Terms and Conditions of Sale may be modified at any time by "the NCDSM" or its agent. The General Terms and Conditions of Sale applicable to the "User" are those in force on the day of his/her order or connection to the present "site". The publisher undertakes, of course, to keep all its former General Terms and Conditions of Sale and to forward them to any "User" who may request them.
If any clause of these General Terms and Conditions of Sale is declared null and void by a court decision, such nullity shall not entail the nullity of all other clauses, which shall continue to have effect.
NCDSM's temporary or permanent refusal to invoke one or more clauses of these General Terms and Conditions of Sale shall in no way imply a waiver of its right to invoke the remainder of the General Terms and Conditions of Sale.
These General Terms and Conditions of Sale are drawn up in the French language. Therefore, only the French version of the General Terms and Conditions of Sale shall be deemed authentic.
The General Terms and Conditions of Sale are subject to the application of French law.
Unless otherwise provided by public policy, any dispute arising in connection with the performance of these General Terms and Conditions of Sale may be submitted to "NCDSM" for amicable settlement. It is expressly reminded that requests for amicable settlement do not suspend the time limits open for bringing legal action.

15. DISPUTES / Mediation

The present General Terms and Conditions of Sale are written in the French language. Therefore, only the French version of the General Terms and Conditions of Sale is binding.
These General Terms and Conditions of Sale are governed by French law. This applies to both substantive and formal rules. In the event of a dispute or claim, "the User" shall first contact "NCDSM" to obtain an amicable solution.
" The User" declares to have been previously informed by "NCDSM" of the possibility of having recourse, in the event of a dispute, to a consumer mediation procedure.
" NCDSM" is a member of the mediation body "Centre de la Médiation de la Consommation de Conciliateurs de Justice" (CM2C), whose contact details are as follows: website https://www.cm2c.net and by post, to the following address: 14 rue Saint Jean 75017 Paris or by telephone: 01 89 47 00 14.
Before contacting the mediator designated above, "the User" undertakes to address his complaint to "NCDSM" Customer Service, using the contact details given on the "Contact" page of the website https://www.savon-de-marseille.com.
